These Terms of Use govern your access to and use of fitora.mk, the Fitora coach dashboard, the Fitora client portal, and related mobile app experiences. By using Fitora, you agree to these terms.
Fitora is operated by the Fitora team. Your use of Fitora is also governed by the Fitora Privacy Policy, which explains how personal information is collected, used, and protected.
1. Fitora service
Fitora provides coaching business software for fitness coaches, nutrition coaches, personal trainers, and coaching teams. The service may include client management, workout planning, nutrition planning, progress tracking, resource libraries, messaging, check-ins, a coach dashboard, and a client mobile portal.
Fitora is currently an MVP and early product. Features may change as the platform develops.
2. Accounts and roles
You must provide accurate account information and keep your login credentials secure. Coaches and coaching businesses are responsible for the users, clients, team members, content, and permissions they manage inside Fitora. Clients are responsible for the information they submit through the client portal and for following the guidance agreed with their coach.
Coach and business accounts may only be created by users who are legally able to enter into these terms. Minors may use the client portal only with appropriate parent or guardian consent where required. Coaches and coaching businesses are responsible for obtaining any required consent before adding minors to Fitora.
3. Coaching, health, and nutrition disclaimer
Fitora is a software platform. Fitora does not provide medical advice, diagnosis, treatment, or professional health, coaching, nutrition, or healthcare services. Workouts, nutrition plans, macros, meals, check-ins, progress measurements, and messages in Fitora are created or managed by users, coaches, or coaching businesses.
Coaches and coaching businesses are responsible for their coaching services, client relationships, qualifications, advice, permissions, and compliance with the laws and professional rules that apply to them. Users should consult qualified health professionals before starting or changing exercise, nutrition, or wellness programs, especially if they have a medical condition, injury, pregnancy, allergy, eating disorder history, or other health concern.
4. User content and client data
You retain ownership of content and data you submit to Fitora, such as client records, notes, workouts, nutrition plans, photos, resources, files, messages, and attachments. You grant Fitora the rights needed to host, process, display, transmit, back up, and otherwise use that content to provide and improve the service.
You are responsible for having the rights and permissions needed to upload, share, or process content in Fitora, including consent from clients where required. Do not upload content that is unlawful, harmful, abusive, misleading, infringing, or otherwise violates another person's rights.
5. Acceptable use
You agree not to:
- misuse Fitora, interfere with the service, or attempt to access systems or data without permission;
- reverse engineer, scrape, crawl, overload, or bypass security or rate limits except as allowed by law;
- use Fitora to send spam, harassment, threats, malware, or deceptive messages;
- upload files, photos, links, or attachments that are illegal, unsafe, infringing, or malicious;
- impersonate another person or misrepresent your affiliation with a coach, client, business, or team;
- use Fitora in a way that violates privacy, data protection, consumer protection, health, or professional rules that apply to you; or
- sell, resell, sublicense, or commercially exploit Fitora unless we have agreed to that in writing.
6. Demos and future paid features
Fitora currently does not provide payment, billing, subscription, refund, or checkout functionality. Fitora may offer demos, trials, paid plans, subscriptions, or payment integrations in the future. If paid features are introduced, pricing and billing terms will be provided separately before purchase.
7. Third-party services and integrations
Fitora may connect with third-party services, such as hosting, email, storage, analytics, push notification, wearable, health, or automation providers. Third-party services are not controlled by Fitora, and their own terms and privacy policies may apply. You are responsible for choosing whether to enable optional integrations and for complying with their requirements.
If Fitora is accessed through an app store, operating system, or mobile platform, that app store or platform's terms may also apply.
8. Intellectual property
Fitora, including its software, design, branding, website copy, product interfaces, logos, and related materials, is owned by Fitora or its licensors and is protected by intellectual property laws. These terms do not transfer ownership of Fitora to you. You may use Fitora only as permitted by these terms or a separate written agreement.
9. Availability and changes
Fitora may change, suspend, improve, or discontinue features from time to time. We aim to provide a reliable service, but we do not guarantee uninterrupted availability, error-free operation, or that every feature will remain available in every plan, region, platform, or app version.
10. Suspension and termination
We may suspend or terminate access to Fitora if we believe an account violates these terms, creates risk for other users, threatens security, infringes rights, or is required by law. You may stop using Fitora at any time. Certain obligations, including confidentiality, intellectual property, disclaimers, indemnity, liability limits, and governing law, may survive termination.
11. Indemnity
You agree to defend, indemnify, and hold Fitora harmless from claims, losses, liabilities, damages, costs, and expenses arising from your content, coaching services, client relationships, misuse of Fitora, violation of these terms, or violation of applicable law. This responsibility is especially important for coaches and coaching businesses that use Fitora to manage clients and coaching records.
12. Disclaimers and liability
Fitora is provided on an "as is" and "as available" basis to the fullest extent permitted by law. We disclaim warranties of merchantability, fitness for a particular purpose, non-infringement, and uninterrupted or error-free operation. To the fullest extent permitted by law, Fitora will not be liable for indirect, incidental, consequential, special, exemplary, or punitive damages, or for lost profits, lost revenue, lost data, business interruption, or coaching outcomes.
To the fullest extent permitted by law, Fitora's total liability for any claim will not exceed EUR 100 or the amount paid to Fitora in the three months before the claim, whichever is greater.
13. Governing law
These terms are governed by the laws of North Macedonia, unless mandatory consumer protection laws require otherwise.
14. Changes to these terms
We may update these Terms of Use as Fitora changes. If changes are material, we will take reasonable steps to notify users, such as by updating this page, sending an email, or showing an in-product notice. Continued use of Fitora after updated terms become effective means you accept the updated terms.
